Requests for internal review under the Aarhus regulation

Individuals and civil society organisations have the right to request an administrative review of legal acts adopted by an EU institution or body, in accordance with the provisions of the Aarhus regulation.

The regulation provides members of the public with the right to access justice and information, and participate in decision-making on matters related to the environment.

An amendment to the regulation adopted by the EU in 2021 extended some provisions concerning the right to request reviews of EU acts.

What is the Aarhus regulation?

The European Union is a signatory to the United Nations’ Aarhus Convention, which sets out rights of individuals and organisations in relation to environmental matters and with regard to:

• access to information
• public participation in decision-making
• access to justice

The EU adopted the Aarhus regulation in 2006 (EC regulation 1367/2006) to apply the provisions of the international convention at EU level. In 2021, an amendment to the regulation was adopted to improve certain aspects of the legislation relating to access to justice.
